Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, landing pages, email newsletter, SMS coaching service, subscription services, supplement products, community, and any other content published under the brand PeakState (collectively, the "Services"). PeakState is operated as a sub-brand of RoleAntagonist ("we," "us," or "our"). By using the Services you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Services.

Disclaimer: This is a starting-point template. Not legal advice. Have a lawyer review before launch, especially because you're processing SMS, payments, health-adjacent content, supplement sales, and potentially non-U.S. users.

1. Eligibility

You must be at least 18 years old to use the Services. By using them, you represent that you are 18 or older.

2. Acknowledgement — what PeakState is NOT

You acknowledge and agree that PeakState is a wellness and habit-support tool. It is NOT:

• Medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before starting any nutrition or fitness program.
• Mental health care. The AI SMS coach is not a therapist, counselor, psychologist, psychiatrist, or crisis service. If you are in crisis, call or text 988 (US) or your local emergency line.
• Addiction recovery treatment. We provide habit nudges, not clinical care. For substance-use help, call SAMHSA at 1-800-662-4357.
• A substitute for human judgment. AI responses may be inaccurate, incomplete, or inappropriate for your situation.

You are solely responsible for decisions you make based on the Services. We disclaim responsibility for outcomes arising from reliance on the content.

3. No earnings, results, or outcome guarantees

Any references to weight loss, body composition, mental state, habit change, or other outcomes are illustrative, not promises. Individual results vary.

4. Your account

Provide accurate info; keep credentials confidential; you're responsible for activity on your account. You must promptly notify us of unauthorized access. We may suspend access for violations or abuse.

5. SMS coaching service

By providing your mobile number and confirming opt-in, you expressly consent to receive automated wellness-related SMS messages from PeakState.

• Consent is not a condition of purchase.
• Msg & data rates may apply.
• Frequency varies based on your settings.
• Opt out anytime: reply STOP to any SMS. We'll send one confirmation and then cease non-transactional SMS.
• Help: reply HELP or email hello@peakstate.app.

Carriers are not liable for delayed or undelivered messages. We may modify or discontinue SMS service at any time.

6. Subscriptions and billing

• Recurring billing. Subscriptions renew monthly or annually until canceled. You authorize us (via Stripe) to charge your payment method.
• Pricing. The price at the time of signup is what you pay; we'll email at least 14 days before any price change for your plan.
• Cancellation. Cancel anytime in your dashboard or by emailing hello@peakstate.app. Cancellation takes effect at the end of the current billing period.
• Refunds. Subscriptions are non-refundable for periods already billed, except where required by law or stated otherwise on the product page. Annual plans: pro-rata refund available only within 14 days of purchase.
• Taxes. You are responsible for applicable taxes.

7. Supplements (if offered)

If we offer supplement products:

• Statements not evaluated by the FDA. Products are not intended to diagnose, treat, cure, or prevent any disease.
• Consult your physician before starting any supplement, especially if pregnant, nursing, under 18, on medication, or with a pre-existing condition.
• Shipping & returns: see the product page. Unopened returns accepted within 30 days; opened products are non-returnable for hygiene reasons.
• Allergens: review labels. You are responsible for checking ingredients against your allergies and prescriptions.

8. License to use our content

Personal, non-exclusive, non-transferable, revocable license to access free content for personal, non-commercial use. Share excerpts with attribution and a link back.

You may not: republish, sell, or sublicense content; train machine learning models on our content or on conversations with our AI coach; remove attribution; use our brand to imply endorsement.

9. Your content and messages

Content you submit — replies, testimonials, community posts, SMS messages to the AI coach, support messages — grants us a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and create derivative works of it solely to operate and improve the Services and for anonymized analytics and training.

You represent that your content does not violate any third-party rights. Don't submit other people's private info, copyrighted material you don't own, or content containing malware.

10. Community rules

Participation in the PeakState community (Discord or similar) is a privilege. We will remove you for:

• Harassment, slurs, threats, or doxxing
• Promoting unlicensed medical, psychiatric, or pharmaceutical advice
• Spam, recruitment to outside services, or affiliate-link flooding
• Sharing others' private info
• Attempting to sell illegal substances or gray-market products

11. Acceptable use

Don't: use Services unlawfully; harass other members; impersonate; attempt unauthorized access; scrape or data-mine; reverse-engineer the AI coach; upload malware; disrupt operations.

12. Third-party services and links

We integrate Kit, Twilio, Stripe, Shopify, Supliful, OpenAI/Anthropic, Discord, and others. Their terms and privacy policies govern your use of those services. Affiliate links disclosed where applicable.

13. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PEAKSTATE, ROLEANTAGONIST, OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES; OR ANY PHYSICAL, PSYCHOLOGICAL, OR FINANCIAL HARM ARISING FROM YOUR USE OF THE SERVICES OR RELIANCE ON AI-GENERATED CONTENT. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR (B) USD $100.

Some jurisdictions don't allow these limitations; in that case they apply to the maximum extent permitted.

15. Indemnification

You agree to indemnify and hold harmless PeakState, RoleAntagonist, and its operator from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the Services, or violation of third-party rights.

16. Termination

We may suspend or terminate access at any time, including for violations or to protect the Services. Sections that by their nature should survive (IP, disclaimers, limitation of liability, indemnification, governing law) will survive termination.

17. Governing law and disputes

Governed by the laws of the State of [INSERT YOUR STATE — e.g., Delaware].

Informal resolution first. Email hello@peakstate.app; we'll try to resolve in good faith for 30 days.

Then binding individual arbitration in [INSERT YOUR COUNTY] under American Arbitration Association rules, except for (a) small-claims court matters and (b) injunctive relief for IP infringement.

Class-action waiver. Disputes brought on an individual basis only. You waive the right to participate in class or representative actions.

18. Changes to these Terms

Material changes will be communicated by email and/or on the website at least 14 days before they take effect. Continued use after the effective date = acceptance.
