PeakState ("we," "us," or "our") is a wellness brand operated as a sub-brand of RoleAntagonist. This Privacy Policy covers our website, email newsletter, SMS coaching service, subscription services, supplement products (if offered), and social media presence (collectively, the "Services"). By using the Services you agree to this Policy.

1. Who we are
PeakState is an independent, creator-run wellness service operated under the RoleAntagonist umbrella. Contact: hello@peakstate.app.
2. What we collect
Directly from you:
- Email address, first name (optional)
- Mobile phone number (required only for SMS coaching; optional otherwise)
- Goals, self-reported habits, check-in responses, meal-plan preferences
- Payment information (processed by Stripe — we never see card numbers)
- Messages you send us or our AI coach
Automatically:
- Device/browser data, IP, usage data, cookies (see Section 8)
From third parties:
- Referral data when you sign up via another user's referral link
We do NOT knowingly collect: government IDs, biometric data, medical records, HIPAA-protected health information, data from users under 18.
3. Health-adjacent data
You may choose to share self-reported wellness data (sleep, mood, nutrition, alcohol, exercise, habits). We treat this data as sensitive even though we are not a HIPAA-covered entity.
- It is stored encrypted at rest and in transit.
- It is never sold.
- It is never shared with advertisers.
- It is used only to deliver your coaching, improve your plan, and (in aggregated, de-identified form) to improve the Service.
- You can delete it at any time by emailing hello@peakstate.app.
4. How we use your information
- Deliver the free playbook, newsletter, and other content you requested
- Operate the AI SMS coach, meal plans, habit tracking, and community
- Process subscription payments and supplement orders
- Provide customer support
- Send marketing with your consent — opt out anytime via email unsubscribe or SMS STOP
- Comply with legal obligations and prevent fraud
- Improve the Service using aggregated, de-identified data
5. Legal bases (GDPR — EU/UK/EEA users)
- Consent: email opt-in, SMS opt-in, marketing cookies, health-adjacent data
- Contract: subscription delivery, SMS coach access, supplement fulfillment
- Legitimate interests: analytics, fraud prevention, Service improvement
- Legal obligation: tax, anti-fraud
Consent can be withdrawn at any time.

7. International transfers
Our providers are primarily U.S.-based. If you're in the EU/UK/EEA, transfers rely on standard contractual clauses or equivalent safeguards.
8. Cookies
We use first- and third-party cookies for site functionality (necessary), Google Analytics 4 (analytics), and preferences. EU/UK users: we'll request consent via a banner before setting non-essential cookies. Disabling cookies may break features.
9. SMS-specific notice (TCPA)
By providing your mobile number and clicking "subscribe" or similar, you expressly consent to receive automated wellness-related SMS messages from PeakState.
- Frequency: varies based on your settings; typically 1–5 messages per day during active check-ins.
- Msg & data rates may apply.
- To opt out: reply STOP to any message. We will send one confirmation and then cease sending non-transactional messages.
- For help: reply HELP or email hello@peakstate.app.
- Carriers: we are not liable for delayed or undelivered messages.
Consent to receive SMS is not a condition of purchase.
10. Retention
- Email subscribers: until unsubscribe, plus up to 12 months in suppression list
- SMS subscribers: until opt-out, plus 12 months in suppression list
- Subscription records: up to 7 years (tax compliance)
- Supplement orders: up to 7 years
- AI coach conversation logs: up to 24 months, or earlier on request
- Analytics: default 14 months
11. Your rights
Depending on your location you may have the right to: access, correct, delete, restrict, object, port your data, opt out of marketing, opt out of sale/share (we don't sell), and be free from discrimination for exercising these rights.

California residents (CCPA/CPRA): see oag.ca.gov/privacy/ccpa. You can also designate an authorized agent.
EU/UK residents: you may complain to your local data-protection authority.
12. Children
PeakState is for adults 18 and older only. We do not knowingly collect data from anyone under 18. If we learn a minor has provided data, we will delete it. Contact us if you believe this has happened.
13. Security
Encryption in transit and at rest, access controls, reputable providers. No system is 100% secure; we cannot guarantee absolute security.
14. Changes to this policy
We may update this Policy. Material changes will be emailed to active subscribers and SMS users. Continued use = acceptance.
